1. Acceptance of Terms

These Terms of Service ("Terms") are a legally binding agreement between you ("User," "you") and CraftOS ("we," "us," "our") governing your access to and use of CraftBot Live (craftbot.live), the CraftOS platform at craftos.net, CraftBot (our open-source personal AI assistant), and any APIs, developer tools, integrations, or related services provided by CraftOS.

By creating an account, downloading CraftBot, or otherwise using our services, you represent that you are at least 18 years of age or have legal authority to enter this agreement.

2. Definitions

  • "Services" encompasses all CraftOS products, platforms, APIs, CraftBot software, websites, and features, including CraftBot Live.
  • "Platform" refers to the cloud-based CraftOS service at craftos.net.
  • "CraftBot" is the open-source, self-hosted AI assistant distributed under the MIT License.
  • "CraftBot Live" is our managed hosting service for CraftBot, accessible at craftbot.live.
  • "User Data" means any data, content, or information inputted or uploaded.
  • "AI Agents" are automated software processes operated by CraftOS.
  • "Outputs" are content, results, or actions generated by AI Agents.
  • "LLM Provider" refers to third-party large language model services.
  • "Third-Party Services" are external platforms integrated via OAuth or API.

3. Account Registration & Access

3.1 Account Creation

You must provide accurate, current, and complete information as prompted by our registration process. Providing false, misleading, or outdated information constitutes a breach of these Terms and may result in immediate termination of your account.

3.2 Account Security

You are responsible for maintaining the confidentiality and security of your login credentials, API keys, and any other authentication mechanisms. You must notify us immediately at info@craftos.net if you become aware of or suspect any unauthorized access to your account, any security breach, or any unauthorized use of your credentials.

CraftOS shall not be liable for any loss, damage, or other consequences arising from your failure to maintain the security of your account or from any unauthorized access that results from your negligence.

4. License Grant & Permitted Use

4.1 CraftOS Platform

Subject to these Terms and payment of applicable fees, CraftOS grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Platform and CraftBot Live during your active subscription period, solely for your own internal business purposes.

4.2 CraftBot

CraftBot is released under the MIT License. You may freely use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of the CraftBot software, provided that the original copyright and license notices are included in all copies.

4.3 Restrictions

You may not use the Services for any unlawful purpose or in violation of applicable law, reverse engineer or decompile proprietary closed-source portions of the Platform, or use the Services to build a directly competing product without prior written consent from CraftOS.

Additional restrictions: you may not use automated means to scrape or crawl the Platform beyond normal API use, transmit spam, malware, phishing materials, or any harmful code, or circumvent or bypass any security, authentication, or access control mechanisms.

5. User Data, Content & AI Outputs

5.1 Ownership of Your Data

You retain all ownership rights in and to your User Data. By using the Services, you grant CraftOS a limited, non-exclusive, worldwide, royalty-free license to process your User Data solely to provide and operate the Services on your behalf.

5.2 Your Responsibility for User Data

You are responsible for ensuring your User Data does not:

  • Infringe third-party intellectual property rights
  • Violate applicable law
  • Contain personal data of third parties without consent
  • Contain content violating the Acceptable Use Policy

5.3 AI Outputs — Important Disclaimer

AI Agents and LLMs produce outputs based on your instructions and may generate inaccurate, incomplete, or unexpected results. CraftOS does NOT warrant the accuracy, reliability, or fitness of any AI Output for any specific purpose.

You are solely responsible for reviewing, validating, and taking responsibility for any action taken based on AI Outputs — especially in financial, legal, medical, or safety-critical contexts.

5.4 No Training on Your Data

CraftOS does not use your User Data, task instructions, prompts, or agent outputs to train our own proprietary AI models without your explicit opt-in consent. Your data remains yours, and we respect the boundary between providing you with a service and using your data for our own purposes.

5.5 Third-Party LLM Processing

When using CraftOS cloud features, your prompts and task instructions are transmitted to your configured LLM Provider. Each LLM Provider's own terms and data handling policies apply independently to data submitted to them. CraftOS has no control over how LLM Providers process or store that data.

5.6 Self-Hosted CraftBot

For self-hosted CraftBot deployments, all User Data, memory, and agent activity remain on your own infrastructure. You are responsible for securing, backing up, and managing that data. CraftOS has no access to locally stored data unless you explicitly enable cloud sync features.

5.7 CraftBot Live (Managed Hosting)

CraftBot Live is our managed hosting service that runs CraftBot on CraftOS infrastructure on your behalf. When you use CraftBot Live, your agent configurations, ChromaDB vector databases, agent memory, conversation history, and workspace files are stored and processed on our servers so that your instance stays online and accessible across devices.

You retain all ownership rights in this data. You grant CraftOS a limited, non-exclusive license to host, store, transmit, back up, restore, snapshot, and otherwise process it solely to operate your CraftBot Live instance and the Services. We do not access instance contents except as necessary to provide the Services, comply with law, enforce these Terms, or address a documented support request from you.

Your use of CraftBot Live is subject to the plan limits published at craftbot.live, including caps on the number of agents, workspace size, bandwidth, and managed-LLM usage. We may suspend, throttle, or hibernate instances that exceed plan quotas, or that we reasonably believe are being used in violation of the Acceptable Use Policy in Section 8.

For operational reasons we may restart, migrate, snapshot, or update instances — for example to apply security patches, rebalance load, or recover from failure. We will use commercially reasonable efforts to minimize disruption. CraftBot Live is provided on a best-effort availability basis; we do not currently offer a contractual uptime guarantee unless separately agreed in writing.

You may pause or delete an instance at any time from your dashboard. Deletion permanently removes the instance's workspace, agent memory, and conversation history from active systems within 24 hours; encrypted disaster-recovery backups are retained and then securely destroyed in accordance with the Privacy Policy.

6. Third-Party Integrations & OAuth

The Services support integrations with third-party platforms. By enabling integrations, you authorize CraftOS to access the specific data and functionality you grant via OAuth or API. You acknowledge that integrated services are governed by those services' own terms and policies.

CraftOS is not responsible for the availability, accuracy, or security of third-party services. Changes to a third-party API may affect integrated features, and we will make reasonable efforts to notify you of any significant disruptions.

7. Subscriptions, Pricing & Payment

7.1 Subscription Plans

Access to CraftBot Live and the CraftOS Platform is available through subscription plans published at craftbot.live and craftos.net/pricing.html. Pricing and features are subject to change with reasonable notice.

7.2 Billing

Subscription fees are billed in advance on a monthly or annual basis. By providing payment information, you authorize CraftOS to charge your selected plan. All fees are non-refundable except as stated herein or as required by applicable law.

7.3 Free Plans & Trials

CraftOS may offer free tiers or trials. At the end of any trial, the Services may revert to a free tier with limited features unless you subscribe to a paid plan.

7.4 Price Changes

We will provide at least 30 days' notice before any price changes take effect for existing subscribers. Continued use after that date constitutes acceptance of the new pricing.

7.5 Taxes

All fees are exclusive of applicable taxes. You are responsible for paying all taxes applicable in your jurisdiction.

7.6 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. CraftOS does not provide pro-rated refunds for partial billing periods unless required by consumer protection law in your jurisdiction.

8. Acceptable Use Policy

You agree not to use the Services to process, generate, or facilitate content or activities that are illegal, harmful, fraudulent, deceptive, or abusive. Prohibited activities include:

  • Content violating privacy or personal data rights
  • Harassment, hate speech, or threats
  • Intellectual property infringement
  • Malware, ransomware, or phishing materials
  • Non-consensual surveillance or stalking
  • Deepfakes or misleading synthetic media
  • Financial fraud or market manipulation
  • Exploitation or harm of minors
  • Unauthorized system access

CraftOS reserves the right to suspend or terminate access for any user found to be in violation of this policy, without prior notice.

9. Intellectual Property

9.1 CraftOS Proprietary Rights

The CraftOS and CraftBot Live names, logos, website designs, and proprietary components of the cloud Platform are owned by CraftOS and protected by applicable intellectual property laws.

9.2 Open-Source Components

CraftBot is made available under the MIT License. Your use of CraftBot's open-source code is governed by the terms of that license. Contributions to the repository are subject to the CONTRIBUTING.md guidelines.

9.3 Feedback

If you provide CraftOS with feedback or suggestions, you grant CraftOS a worldwide, perpetual, irrevocable, royalty-free license to use such feedback for any purpose, including incorporating it into future versions of the Services, without any obligation to compensate you.

10. Disclaimers & Warranties

THE CRAFTOS PLATFORM, CRAFTBOT LIVE, CRAFTBOT, AND ALL RELATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

Specifically, CraftOS does not warrant that the Services will be error-free, uninterrupted, or always available, that AI outputs will be accurate or suitable, or that the Services will meet your specific business requirements.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CRAFTOS AND ITS FOUNDERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

Our total liability is limited to the greater of the fees you paid to CraftOS in the 12 months preceding the claim, or JPY 10,000.

12. Indemnification

You agree to defend, indemnify, and hold harmless CraftOS, its founders, officers, contractors, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services, your User Data, your violation of these Terms, your violation of any applicable law or the rights of a third party, and your use or misuse of AI Outputs.

13. Term & Termination

13.1 Term

These Terms remain in effect from the date you first access the Services until terminated by either party.

13.2 Termination by You

You may terminate your account at any time by deleting your account in Settings or by contacting info@craftos.net. Termination does not entitle you to a refund for pre-paid fees.

13.3 Termination by CraftOS

CraftOS may suspend or terminate your access immediately and without notice if you breach these Terms, engage in activities that threaten the security or integrity of the Services, or if required by applicable law. For non-urgent violations, we will provide reasonable notice where practicable.

13.4 Effect of Termination

Upon termination, your license to use the Services ends immediately, we will retain or delete your data per our Privacy Policy, and provisions that by nature should survive (intellectual property, limitation of liability, indemnification, dispute resolution) will continue to apply.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Japan, and both parties agree to submit to the personal jurisdiction of such courts.

We encourage you to contact us first at info@craftos.net to resolve any dispute informally before initiating formal proceedings. We will make good-faith efforts to resolve disputes within 30 days.

15. General Provisions

These Terms, together with our Privacy Policy and any Order Form, constitute the entire agreement between you and CraftOS regarding the Services.

If any provision is invalid, the remaining provisions continue in full force and effect. Failure to enforce any provision shall not constitute a waiver of future enforcement rights.

You may not assign your rights without our consent, though CraftOS may assign these Terms in connection with a merger, acquisition, or sale of assets.

CraftOS is not liable for delays or failures resulting from circumstances beyond our reasonable control, including natural disasters, cyberattacks, or third-party service outages.

All legal notices to CraftOS should be sent to info@craftos.net, and we will provide notices to you via the email address associated with your account.

We may update these Terms at any time, and material changes will be communicated via email and a notice on our website at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
